17 year-old breaks into funeral home, beats woman’s corpse

He may not be charged for the beating – turns out being a cretinous abomination isn’t a crime.
A teenage boy allegedly broke into an Albuquerque mortuary and beat up a female corpse being kept there. Dominic Goodmoney, 17, was arrested Sunday night near Reflections Funeral & Life Celebrations. He was covered in blood, digging into his own cuts and banging his head against a building, according to police.
On Wednesday he appeared in court charged with aggravated burglary while armed, criminal damage to property, tampering with evidence and larceny. In addition to beating the female corpse he also made a mess of the mortuary, police said.
However Goodmoney is unlikely to face any charge for what was described as blunt-force trauma to the face of the dead women.
“There’s a gap in New Mexico law that doesn’t cover the actual harm done to the corpse,” Pat Davis, spokesman for the Bernalillo County District Attorney, said. “Unfortunately, New Mexico law doesn’t have a charge for tampering with a corpse at this stage of the process.”
“I think that’s something that none of us realized.”

Is sounds like the only crime that was commited here was breaking and entering, and vandalism.
Tampering with evidence?
Ok, so if the body was in the morgue, I could see this, but it wasn’t. By the time the body gets to a mortuary it’s already been processed. It’s no longer evidence, so, that charge would be ridiculous.
Beating?
Other than being disrespectful, no harm was done.
Other problems?
It was likely a very emotional crime, especially since he turned to self mutilation. Is there a possibility of past abuse perpetrated by the deceased women, or something else to explain this?
Who’s surprised? These little animals are getting worse and worse every year.

Breaking and entering with intent to destroy property is not a crime?
New Mexico has to catch up and make laws to cover this. Also, since when is it okay to wear gang colors and flash associations while being photographed for the police or the news? That just promotes that “horse puckey” and enough of our kids die from it every year we shouldn’t be promoting it;especially with the dangerous Mexican gangs coming up and setting up shop in American Southwestern cities.

Uh, we need federal legislation forbidding (1) Bestiality, (2) Necrophilia (even if you didn’t kill the body being outraged), and (3)assault & battery on a corpse. I just recalled doing a story where a guy is arrested for pummeling a dead body during a funeral (turned out the perp had loaned the deceased $50 and was never repaid. So he felt justified in sending the guy to his long home beaten into trash !)
